Terms of service
By using Blumi you agree to these terms.
Effective 1 January 2025. Questions? Email hello@blumi.app.
1. Acceptance
By creating an account or using Blumi you agree to these Terms. If you're using Blumi on behalf of an organisation, you confirm you have authority to bind that organisation.
2. Your account
You're responsible for the activity that happens under your account. Keep your password secure and notify us at security@blumi.app of any suspected unauthorised access.
3. Acceptable use
You agree to follow our Acceptable Use Policy. In short: don't use Blumi to break the law, harass anyone, or threaten the safety of participants or staff.
4. Data ownership
Your organisation owns the data it enters into Blumi. We process it under the Data Processing Agreement and the Privacy Policy.
5. Subscription & payment
Paid plans are billed monthly or annually in advance. Subscriptions renew automatically until cancelled. You can cancel at any time; cancellations take effect at the end of the current billing period.
6. Trial periods
If we offer a free trial, you can use Blumi for the trial period without payment. If you don't cancel before the trial ends, your subscription will start automatically at the rate listed when you signed up.
7. Service availability
We aim for high availability but don't guarantee uninterrupted service. We may schedule maintenance and will give reasonable notice for planned downtime.
8. Suspension & termination
We may suspend or terminate access if you breach these Terms, fail to pay, or use Blumi in a way that puts other users or our systems at risk. You can terminate at any time by closing your account.
9. Warranties & liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. Subject to those non-excludable rights, Blumi is provided on an "as is" basis, we exclude all other implied warranties to the maximum extent permitted by law, and our total aggregate liability is limited to the amount you've paid us in the 12 months before the claim.
10. Indemnity
You'll defend and indemnify Blumi against third-party claims arising from your use of the platform in breach of these Terms.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and Blumi submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth courts sitting in Sydney.
12. Changes
We may update these Terms from time to time. Material changes will be notified in-app or by email at least 30 days before they take effect.
